BY-LAWS OF THE CENTRAL NEW YORK UMPIRES ASSOCIATION

ARTICLE I – MEMBERSHIP

                Section 1.  ACTIVE MEMBER

A.      Those who are members in good standing when these By-Laws become effective and/or who have satisfactorily completed the prescribed probation period.

 

Section 2.  ADMISSION TO MEMBERSHIP 

A.      Application for probationary membership shall be accompanied by a fee determined by the Executive Board.

B.      Applicant to be examined by the membership committee by written examination.  In certain cases, the written examination may be waived by the Executive Board with majority vote.

C.      After certification by the membership committee, the applicant is admitted to probationary membership.

 

 

ARTICLE II – RULES AND REGULATIONS

Section 1.  Any member except the Umpire-in-Chief may be a player, manager, coach, sponsor of any team in any league in which our members officiate.  However, the member may not officiate in that same league in which he is a player, manager, coach or sponsor except with majority Executive Board approval.

 

Section 2.  No member shall work for less than the prevailing fees unless it is for a Tournament negotiated by and approved by the Executive Board.

 

Section 3.  The Executive Board may approve a Tournament fee schedule with a simple majority of the entire Executive Board.

 

Section 4.  No member shall officiate a game with another official who is not a member of this Association.  An exception to this rule are all College and High School Softball games provided the other official is a member in good standings of a recognized umpire association; such exception approval must be granted by a majority of the Executive Board. 

 

Section 5.  Any member working a game in any league, beer game, or exhibition game without the consent of the Umpire-in-Chief shall be suspended immediately.

 

Section 6.  No member shall be assessed or required to perform any duties for the Association, or shall be induced in any manner to perform any work beyond that which is stipulated in these By-Laws and Constitution, other than determined by a 2/3 vote of the Executive Board in attendance; and said member may not be penalized as a result of refusing.

 

Section 7.  Should one (1) official officiate a game ordinarily worked by two (2) officials, the game fee shall be a game and ½ fees.

 

Section 8.  An official who is late or fails to show up shall be subject to disciplinary action and fine by the Executive Board.

 

Section 9.  Upon the death of any member in good standing, the Association will make a donation of one (1) floral piece or one (1) Mass Card or cash donation to the family of the deceased

 

Section 10.  All claims for fees not paid to an umpire must be in writing or E-Mail and sent to the treasurer.  Said notice must be [postmarked within 48 hours and must contain the following information:

a.       Date of Assigned Game

b.      Field

c.       Both Teams involved

d.      Reason for non-payment (forfeit, rain guarantee, wet field, etc.)

 

Section 11.  All members of this Association shall wear the Official Uniform as authorized by the USSSA Rule Book Rule 10, Section 2 and the Executive Board.

 

Section 12.  No alcoholic beverages are allowed at meetings.

 

Section 13.  All meetings will be held during the softball season.

 

Section 14.  Semi-monthly meetings will be held at the discretion of the President and/or the Executive Board.

 

Section 15.  Each member is to be notified by the Secretary before all out of season meetings.

 

Section 16.  Any member absent from two (2) consecutive meetings shall be notified by the Secretary that absence from the next meeting will be cause for suspension.  Extent of the suspension will be determined by a majority vote of the Executive Board.

 

Section 17.  New members are not eligible to work playoff games. (Exception – Emergency Cases)

 

Section 18.  The Umpire-in-Chief shall handle all protests.

 

Section 19.  The Umpire-in-Chief may designate active or honorary members to check probationary members in his staid.  The Umpire-in-Chief shall make a report to the Executive Board with recommendations for each probationary member.

 

Section 20.  Should umpire(s) be assigned to a field and neither team appear, the Association is responsible for fees to umpire(s) upon notice.  Fees are to be determined by the Executive Board with a minimum of $3 show-up fee per umpire.

 

ARTICLE III – DUES

Section 1.  All dues for the following year are due and payable in full by the 1st of August of the present year.  If payment is not received by August 1st, then that umpire will

a.       Continue in good standing for the remainder of the present year.

b.      Not be allowed to reenter the organization for the following year except by applying with new umpires.  This means being assessed the same fees as new umpires and completing new umpiring school.

 

Section 2.  Dues shall be determined by the Executive Board before the March meeting and approved by the members at the regular March meeting.

 

Section 3.  Should any deficit occur in the treasury, the Executive Board by a majority vote of the entire board may assess the members equally to cover such indebtedness?

 

Section 4.  Any member by written application to the Executive Board may resign or withdraw for one (1) year only and may pay a withdrawal fee of $1.00.  If resignation or withdrawal is longer than one (1) year, the member loses all rights in the Association and must rejoin as a probationary member.

 

 

ARTICLE IV – FEES AND DELINQUENY

Section 1.  A fee of 5% per game is charged to every member of each game he works.  Said total fee must be paid within two (2) weeks of billing to the Umpire-in-Chief.   

 

Section 2.  If said fee is not paid on the time specified, the member shall be declared delinquent and notified as such by the Umpire-in-Chief through the Secretary. 

 

Section 3.  Delinquent members shall stand suspended for a period determined by the Executive Board and outstanding payment will include a $1.00 handling fee for delinquency.

 

                Section 4.  If delinquent fee is not paid, the treasury shall pay the delinquent fee by December 1.

 

 

ARTICLE V –TOURNAMENT

Section 1.  These by-laws provide that a softball tournament may be held, but the proceeds shall be specific, and determined in the budget, and disbursement or funds directed from there.

 

Section 2.  The President shall appoint a committee to handle all phases whatsoever of the softball tournament, should one be held.

 

Section 3.  All monies raised by any means shall be used to promote softball.  This includes dinner dances, clambakes and education or social affairs for members.  

 

 

 

 

 

 

ARTICLE VI – COMMITTEES

Section 1.  The President will determine if any of the following committees are needed and shall appoint members in good standing to the following the committees prior to the first meeting of each year:

a.       Nomination Committee

b.      By-Law Committee

c.       Tournament Committee

d.      Budget Committee

e.      Membership Committee

f.        Finance Committee

g.       Social Committee

h.      Ways and Means Committee

i.         Rules Committee

j.        Grievance Committee

k.       Sunshine Committee

 

Section 2.  The President shall detail the duties of each committee in writing and furnish the chairman of each committee one (1) copy pertaining to that particular committee.

 

                Section 3.  A minimum of two (2) members shall comprise a committee.

 

 

ARTICLE VII – AMENDMENTS

                Section 1 These by-laws may be amended in the same manner as that is specified for the Constitution of the CNYSUA.
